TERMS AND CONDITIONS – COLLECTGIRLS

1. ABOUT THESE TERMS
These Terms and Conditions govern your access to and use of the CollectGirls website, accounts, game systems, digital content, virtual currency, purchases and related services (together, the “Service”).
By creating an account, purchasing CollectGirls Coins, opening a pack or otherwise using the Service, you agree to these Terms, our Privacy Policy, Refund Policy and Community Guidelines. If you do not agree, do not use the Service.
2. ELIGIBILITY
CollectGirls is intended only for people aged 18 years or older. By using the Service, you confirm that you are at least 18, have the legal capacity to accept these Terms and may lawfully use the Service where you live.
We may suspend or close an account where we reasonably believe that eligibility information is false or that continued access would create a legal, safety or security risk.
3. ACCOUNTS AND ACCOUNT SECURITY
You must provide accurate account information and keep your login credentials secure. You are responsible for activity occurring through your account, except to the extent caused by CollectGirls or another matter for which responsibility cannot lawfully be placed on you.
You must not sell, buy, lend, share or transfer an account, impersonate another person, use misleading identity information, evade an enforcement action or create accounts for fraud, automation or abuse.
Notify us promptly at {email} if you suspect unauthorised access. We may require reasonable verification before changing account details or restoring access.
4. THE COLLECTGIRLS SERVICE
CollectGirls is a digital card collecting game featuring original CollectGirls characters and artwork. Features may include card packs, collections, profiles, the Daily Wheel, Fusion Lab, achievements, statistics, seasonal content, events, leaderboards and other systems introduced over time.
We may add, remove, rename, rebalance, rotate, retire, pause or replace content and features. Card availability, rarity, appearance, value, pack contents, reward rates, prices and game rules may change. A particular card, pack, feature or reward is not guaranteed to remain available indefinitely.
Scheduled maintenance, outages, security incidents, third-party failures and events outside our reasonable control may interrupt the Service.
5. COLLECTGIRLS INTELLECTUAL PROPERTY
CollectGirls owns or licenses all rights in the Service and its content, including the CollectGirls name, branding, logos, original characters, character designs, artwork, card designs, text, animations, audio, software, databases, user interface and visual presentation.
Except for the limited licence granted below, no rights are transferred to you. Purchasing Coins, opening packs or obtaining cards does not give you ownership of any artwork, character, copyright, trade mark, source code or other intellectual property.
You must not copy, reproduce, republish, sell, distribute, scrape, extract, mirror, frame or commercially exploit CollectGirls content without prior written permission.
6. LIMITED USER LICENCE
While your account remains permitted to access the Service, CollectGirls grants you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for private entertainment in accordance with these Terms.
This licence does not permit commercial use, resale, sublicensing, public redistribution, creation of competing datasets or services, or use outside the normal functions provided by CollectGirls.
7. AI TRAINING, SCRAPING AND DATA EXTRACTION
You must not use CollectGirls content, artwork, character designs, text, metadata, card information or other Service data to train, fine-tune, evaluate or supply an artificial intelligence or machine-learning system without prior written permission.
You must not use crawlers, bots, scripts, browser automation, bulk download tools, data-mining tools or similar methods to collect, reproduce or index content, accounts, inventories, profiles or Service data except where expressly authorised by CollectGirls.
8. REVERSE ENGINEERING AND TECHNICAL RESTRICTIONS
You must not reverse engineer, decompile, disassemble, probe, bypass, defeat or interfere with the Service, its access controls, rate limits, security measures, payment checks or server-side game logic, except where a restriction is prohibited by law.
You must not access non-public endpoints or data, alter requests, forge responses, manipulate browser or server state, inject code, distribute cheats, exploit vulnerabilities or assist another person to do so.
9. COLLECTGIRLS COINS AND DIGITAL ITEMS
CollectGirls Coins, cards, variants, rewards and other virtual items are digital features licensed for use within the Service. They are not legal tender, stored value, cryptocurrency or property that can be redeemed for cash.
Unless CollectGirls expressly enables a feature, virtual items cannot be sold, transferred, gifted, exchanged for money or moved outside the Service. Any displayed card or collection value is an in-game value only and is not a promise of market or cash value.
We may correct balances or inventories affected by error, fraud, chargeback, exploit, duplicated delivery or unauthorised activity. We will not remove lawfully purchased digital content arbitrarily, but access may be affected by lawful enforcement, service changes or circumstances described in these Terms.
10. PACKS AND RANDOMISED REWARDS
Digital packs may provide random cards, rarities or variants. Outcomes are generated under the game rules and probabilities applying when the pack is opened. Unless there is an error, fraud or legal entitlement to a remedy, a player is not guaranteed a particular card, rarity, variant or total in-game value.
Duplicate cards, an unwanted result, a lower rarity than hoped for or a result that does not improve your collection are not, by themselves, defects or grounds for a refund.
Displayed probabilities may be rounded. We may rebalance future pack outcomes, but changes will not ordinarily reroll packs already opened.
11. DAILY WHEEL, FUSION LAB AND FREE REWARDS
Free rewards, wheel spins, promotional Coins and Fusion Lab outcomes may be subject to cooldowns, eligibility requirements, limits and anti-abuse controls. They may be changed, paused or withdrawn.
You must not manipulate device time, accounts, browser state, requests or databases to claim extra rewards or obtain unintended outcomes.
12. PAYMENTS
Prices, currency and bundle contents are shown at checkout. Payments may be processed by Stripe or another disclosed payment provider. A purchase is complete only after successful confirmation through CollectGirls’ server-side systems.
Do not send us complete payment card numbers or security codes. Payment providers handle sensitive card information under their own terms and privacy practices.
We may delay, refuse, reverse or investigate a transaction where reasonably necessary to address fraud, duplicate processing, unauthorised payment, technical error, legal requirements or a breach of these Terms.
13. REFUNDS AND CHARGEBACKS
Refunds and corrections are governed by our Refund Policy and applicable law. Digital purchases are generally not refundable merely because a user changes their mind, receives duplicate cards, dislikes a random result or later decides not to use the Service.
Please contact us before opening a payment dispute so we can investigate. Where a payment is reversed or charged back, we may lawfully remove associated Coins or items, restrict the account during investigation and provide transaction and delivery records to the payment provider.
Fraudulent chargebacks, repeated refund abuse or knowingly false payment claims may result in suspension or termination. Nothing in this section limits rights that cannot be excluded under the Australian Consumer Law.
14. PLAYER CONDUCT
You must follow the Community Guidelines. Prohibited conduct includes harassment, hateful or threatening behaviour, impersonation, inappropriate usernames, fraud, account trading, cheating, bots, exploit abuse and interference with other users or the Service.
15. USER SUBMISSIONS AND FUTURE SOCIAL FEATURES
If CollectGirls allows usernames, profile text, messages, uploads, comments, guilds, trading, gifting or other user submissions, you remain responsible for what you submit.
You must have all necessary rights to submitted material. You grant CollectGirls a non-exclusive, worldwide, royalty-free licence to host, reproduce, moderate, display and process it as reasonably required to operate, protect and improve the Service.
We may remove or restrict submissions that breach these Terms, the Community Guidelines, another person’s rights or applicable law.
16. SECURITY REPORTING
Security issues should be reported privately to {email}. Do not access other users’ information, retain data, disrupt the Service, demand payment, or publicly disclose an issue before we have had a reasonable opportunity to investigate and respond.
Reporting a vulnerability does not authorise actions that would otherwise be unlawful or harmful.
17. SUSPENSION AND TERMINATION
We may warn, restrict, suspend or terminate an account where we reasonably believe this is necessary because of a material breach, fraud, cheating, payment abuse, security risk, unlawful conduct, repeated harmful behaviour or an attempt to evade enforcement.
We may preserve relevant records and reverse benefits obtained through misconduct. The severity and duration of enforcement may reflect the conduct, risk, history and available evidence.
You may stop using CollectGirls at any time and may request account deletion under the Privacy Policy. Account closure does not convert virtual items into cash or automatically create a refund entitlement.
18. THIRD-PARTY SERVICES
The Service may rely on third-party providers such as Supabase, Stripe, hosting, email, security and analytics services. Those services may be subject to separate terms and may experience outages or changes outside our control.
CollectGirls is not responsible for third-party websites linked from the Service or for their content and practices.
19. DISCLAIMERS
To the maximum extent permitted by law, the Service is provided on an “as available” basis. We do not guarantee uninterrupted availability, compatibility with every device, permanent preservation of every feature or freedom from all errors and security risks.
Nothing in these Terms excludes any guarantee, warranty or condition that cannot lawfully be excluded.
20. LIMITATION OF LIABILITY
To the maximum extent permitted by law, CollectGirls is not liable for indirect, incidental, special or consequential loss, loss caused by a user’s insecure credentials or unlawful conduct, or failures of third-party services beyond our reasonable control.
Where liability cannot be excluded, it is limited only to the extent permitted by law. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot be excluded, including applicable rights under the Australian Consumer Law.
21. INDEMNITY
To the maximum extent permitted by law, you agree to compensate CollectGirls for reasonable loss, liability, damage, cost or expense caused by your unlawful conduct, infringement of another person’s rights, fraudulent activity or material breach of these Terms. This does not apply to the extent a loss was caused by CollectGirls or cannot lawfully be imposed on you.
22. CHANGES TO THE SERVICE AND THESE TERMS
We may update the Service and these Terms as the game, providers, business or legal requirements change. Updated Terms apply from the date stated when published.
Where reasonably practicable, we may give notice of material changes through the Service or by email. If you do not accept updated Terms, you must stop using the Service.
23. GOVERNING LAW
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. Subject to any non-excludable right to bring a matter elsewhere, the courts with jurisdiction in South Australia may hear disputes relating to these Terms.
24. GENERAL TERMS
If part of these Terms is invalid or unenforceable, the remaining parts continue to operate. A delay in enforcing a right is not a waiver. These Terms and the linked policies form the agreement between you and CollectGirls concerning the Service.
